{"id":3017,"date":"2018-04-19T07:53:47","date_gmt":"2018-04-19T17:53:47","guid":{"rendered":"http:\/\/dod.hawaii.gov\/hiema\/?p=3017"},"modified":"2019-08-08T15:01:06","modified_gmt":"2019-08-09T01:01:06","slug":"3017-2","status":"publish","type":"post","link":"https:\/\/dod.hawaii.gov\/hiema\/3017-2\/","title":{"rendered":"SUPPLEMENTARY PROCLAMATION"},"content":{"rendered":"<p>OFFICE OF THE GOVERNOR<br \/>\nSTATE OF HAWAI\u02bbI<\/p>\n<p style=\"text-align: center;\"><strong>SUPPLEMENTARY PROCLAMATION<\/strong><\/p>\n<p>By the authority vested in me as Governor by the Constitution and laws of the State of Hawai\u02bbi, in order to provide relief for disaster damages, losses, and suffering, and to protect the health, safety, and welfare of the people, I, DAVID Y. IGE, Governor of the State of Hawai\u02bbi, hereby determine, designate and proclaim as follows:<\/p>\n<p>WHEREAS, pursuant to Chapter 127A, Hawaii Revised Statutes, emergency powers are conferred on the Governor of the State of Hawai\u02bbi to deal with disasters or emergencies, to maintain the strength, resources, and economic life of the community, and to protect the public health, safety, and welfare; and<\/p>\n<p>WHEREAS, it has become necessary to supplement my Proclamation of April 15, 2018, relating to heavy rains and flooding; and<\/p>\n<p>WHEREAS, the conditions giving rise to the emergency continue in the county of Kauai and have also occurred in the City and County of Honolulu, State of Hawai\u02bbi; and<\/p>\n<p>WHEREAS, the Mayor of the City and County of Honolulu declared an emergency for the City and County of Honolulu on April 18, 2018 as a result of damage to homes, private and public property and facilities, and threats of additional damage and injuries from continuing rains and flooding; and<\/p>\n<p>WHEREAS, the disaster occurrence of heavy rains and flooding beginning April 14, 2018 has caused extensive damage to private and public property impacting the County of Kauai and the City and County of Honolulu, State of Hawai\u02bbi, thereby continuing to endanger the health, safety, and welfare of the people; and<\/p>\n<p>NOW, THEREFORE, I, DAVID Y. IGE, Governor of the State of Hawai\u02bbi, hereby determine that an emergency or disaster contemplated by sections 127A-14, 171-85, 209-2, Hawaii Revised Statutes continues in the County of Kauai, and the City and County of Honolulu, State of Hawai\u02bbi, and do hereby proclaim these areas to be disaster areas and continue and extend my proclamation of April 15, 2018 relating to heavy rains\u00a0and flooding in order to provide emergency relief and hereby authorize and invoke the following measures under the Hawaii Revised Statutes:<\/p>\n<p>1. Sections 127A-13 and 127A-12, Hawaii Revised Statutes, I hereby suspend as allowed by federal law and to the extent necessary to provide emergency relief as a result of this event, the following additional statutes:<br \/>\na. Chapter 342H, Hawaii Revised Statutes, solid waste pollution.<\/p>\n<p>I\u00a0 FURTHER DECLARE that all the provisions of my proclamation of April 15, 2018, including the provisions and applicability of section 127A-30, Hawaii Revised Statutes, shall remain in full force and effect and are hereby included in the provisions of this Supplementary Proclamation and the disaster emergency relief period shall now continue until terminated sixty days after this day or by a separate proclamation, whichever occurs first. Notwithstanding the termination of a disaster emergency relief period, any contracts, agreements, procurements, programs, or employment of personnel entered into, started, amended, or continued by reason of the provisions of the proclamations relating to this emergency shall continue.<\/p>\n<p>Done at the Hawai\u02bbi State Capitol, this 18th day of April, 2018.<\/p>\n<p>DAVID Y.
